A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.

Punishment of the crime

Despite the fact that the Defendant is not a narcotics handler, the Defendant treated the Mept Ampha (hereinafter referred to as “philopon”) of a local mental medicine as follows:

1. Receipt and administration of philophones;

A. On May 6, 2017, the Defendant received delivery of a disposable injection device from D free of charge in the alleyway near the C S. S. S. “C S. S. S. S. S. S. S. S. S.” and received it.

B. The Defendant: (a) entered a nearby restaurant that received philophones from D as above and administered the said phiphones by a method of drinking alcohol.

2. Trading and medication of phiphones.

A. On August 13, 2017, the Defendant purchased approximately 0.4g opon 200,000 won in cash from D in front of the above “C Symbook” (hereinafter “C Sym”).

B. On August 14, 2017, at around 19:00, the Defendant injected approximately 0.1g of phiphones purchased from public toilets located in the Gwanak-gu Seoul Special Metropolitan City EM market, which contained 0.1g of phiphones purchased as above, into a single-use injection machine, and injected them into arms.

On August 15, 2017, at around 12:00, the Defendant administered approximately 0.1g of phiphonephones purchased at the Defendant’s residence in Gwanak-gu, Seoul Special Metropolitan City, by means of dilution with raw water and injection into arms.

1. Article 62 (1) of the Criminal Act on the suspended execution;

1. Orders to observe protection and attend lectures under Article 62-2 of the Criminal Act;

1. The Act on the Management of Narcotics, etc. for Additional Collection;
