A defendant shall be punished by imprisonment for not less than one year and six months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

[2013 Highest 7559] No trademark identical to the registered trademark of another person shall be used for goods identical or similar to the designated goods, nor shall it be possessed for delivery of goods identical or similar to the designated goods bearing the registered trademark of another person or any similar trademark.

피고인은 2013. 10. 27.경 서울 중구 C시장 D 앞 도로에서, 피해자 루이비통 말레띠에사가 국내 특허청에 등록한 LOUIS VUITTON(등록번호: 제0486828호)의 위조 상표가 부착된 목도리를 판매할 목적으로 전시한 것을 비롯하여 별지 범죄일람표 기재(다만 와 같이 피해자 상표권자 루이비통 말레띠에, 크리스티앙 디오르 꾸뛰르, 샤넬, 버버리 리미티드, 캘빈클라인 트레이드마크 트러스트, 가도에스알엘, 스타벅스 코포레이션 디 비 에이 스타벅스커, 헤르메스 엥떼르 나씨오날, 이또츄쇼지 가부시끼 가이샤, 퓨마 에스이, 더폴로 로렌컴파니엘피, 조르지오 아르마니 에스피에이, 나이키 인코퍼레이션, 토미힐휘거 라이센싱 엘엘씨, 휀디 아델레에스알엘, 아디아스 악티엔게젤샤프트, 구치오구치 쏘시에 떼퍼아찌오니사의 각 위조 상표가 부착된 목도리, 지갑, 양말, 타올 등 총 928점(정품 추정시가 합계 197,025,000원)을 판매할 목적으로 전시하였다. 피고인은 위와 같이 별지 범죄일람표 기재 상표권자들의 상표권을 침해하였다. [2013고정6252] 피고인은 2013. 10. 19. 14:50경 서울 중구 C시장 내에서 구치사가 특허청에 제0648019호로 상표등록(최종 권리자: 구치오구치 쏘시에 떼퍼아찌오니 한 구치 상표와 유사한 모양의 위조 상표가 부착된 지갑 6점을 비롯하여 아래 범죄일람표 기재와 같이 지갑 11점을 판매할 목적으로 진열하여 상표권자들의 상표권을 침해하였다.
