Reasons
Summary of the facts charged “2015 Goym3693”
1. Except as otherwise expressly provided for in any other Act, no person who has violated the Electronic Financial Transactions Act shall borrow or lend a means of access, or keep, deliver or distribute a means of access in receiving, demanding or promising to receive any compensation;
Around March 18, 2015, the Defendant received text messages stating “The arbane, detailed contents that can be KRW 3 million a month,” and offered a proposal to lend the passbook in the name of the Defendant to a person who assumes the name of the Defendant from the person who assumes the name of the Defendant Company C by telephoneing his/her number, and to give 3% of the amount deposited in the passbook as the fee.
On March 19, 2015, at around 12:00, the Defendant lent one passbook (E) under the name of the Defendant to the bearer (title D) who misrepresented his/her employees from the company, and withdrawn the money deposited in the above passbook (F), and then lent the means of access in return for 3% of the withdrawn amount.
2. A computer, etc. used for fraud;
A. On March 18, 2015, the Defendant: (a) received the word “Librate 3 million won” as above, and made a suspicion that the Defendant lent two passbooks under the name of the Defendant in contact with his name; and (b) made a withdrawal of the money deposited with the passbook as commission; and (c) made a suspicion that 3% of the money deposited with the passbook would be illegal to the person under whose name the passbook was entered; and (d) made an illegal daily guidance, such as Bosing, etc., by asking him.
On March 19, 2015, the above under-mentioned victims sent money to the above SC bank account under the victim's name by misrepresenting the public prosecutor's office to the victim G and making the victim deposit money to the above SC bank account with the victim's name in order to prevent damage from being involved in the large passbook case.
