1. As to the real estate indicated in the annexed real estate:
A. Defendant lot Construction Co., Ltd.
Reasons
In fact, on November 25, 1991, Defendant Ringk Construction Co., Ltd. (hereinafter “Lingk Construction”) entered into a commercial supply contract with the following terms: (a) as to the real estate indicated on the attached real estate (hereinafter “instant real estate”) in the construction, the down payment of KRW 124,002,00 and the total amount of KRW 620,010,000; and (b) as to the real estate indicated on the attached real estate (hereinafter “instant real estate”) in the construction, the sales contract with the following terms: (a) Defendant Ringk Construction Co., Ltd. (hereinafter “Singk Construction”) paid the down payment on the day of the contract; and (b) Defendant Pingk Construction paid the intermediate payment of KRW 262,784,920 on the day of the contract; and (c) the intermediate payment of KRW 386,786,920 on the day of
Based on the premise that the ownership of the instant real estate is transferred from Defendant Barun Construction, Defendant Sejong-si divided the instant real estate into 17 areas (1-17) and entered into a sales contract with 14 persons (hereinafter “instant buyers”) in total from December 4, 1991 to October 9, 193 (hereinafter “each of the instant sales contracts”) and received KRW 623,414,040 from the instant buyers in total as down payment and intermediate payment.
After the completion of the instant real estate on July 1993, the registration of ownership preservation was made in the future of the construction on August 6, 2013.
The Plaintiff acquired the claim under each of the instant sales contracts from the instant buyers, and acquired the obligation.
On July 6, 2016, the Plaintiff acquired the claim for the supply of commercial buildings amounting to KRW 233,223,080 against Defendant Sejong Trade, and offset this claim against the unpaid purchase price claim amounting to KRW 229,307,660 against the Plaintiff of Defendant Sejong Trade.
