Reasons
Punishment of the crime
1. Fraud against the victim C;
A. On May 2, 2013, the Defendant made a false statement to the victim of the Gangwon-gun Down-gun, stating that “The pawnggran is operated in Hanwon-gun, and the funds for the operation of the pawnggran are required, and the interest shall be paid in 1.5 million won per month, and the principal shall be repaid until December 2, 2013.”
However, the defendant did not operate the pawning Center at the time, and he did not intend to use it as the fund for the operation of the pawning Center even if he received the money from the victim because he thought that the above money will be invested in the bond company by borrowing the money.
In addition, there was no property owned by the Defendant, and there was a debt of 1.23 billion won to those who were e and F and a debt of 3.5 million won, and the interest was paid by the KB National Bank Credit Card loans from other persons. However, there was a circumstance that the interest was paid by the loan from other persons, and there was a debt of 3.0 million won per month for the children's study expenses, and there was a reason that there was a reason that an investment made by the bond company with respect to the bonds company did not have an intent or ability to repay the debt by December 2, 2013, even if it was borrowed money from the victim.
As above, the Defendant, by deceiving the victim as above, received KRW 25 million from the victim’s new bank account (H) to the Defendant’s new bank account (G) and KRW 25 million from the victim’s national bank account (I) to the Defendant’s new bank account (H) respectively.
B. Around July 17, 2013, the Defendant called the victim at the above place and made a false statement to the effect that “If operating funds need to be increased, 10 million won will be lent to the Gangseo Islands, 10 million won as principal and interest will be paid one million won after one week.”
However, in fact, the defendant did not operate the pawnban at the time, and he thought that he would make an investment in the J that he would grant the profit by borrowing the above money, and therefore he would be entitled to money from the victim.
