Reasons

1. There is no dispute between the parties to the facts of recognition, or the following facts are acknowledged in full view of the purport of the entire arguments in the statements in Gap evidence Nos. 1 to 10, 14, Eul evidence Nos. 2 and 3.

가. 토지매매약정의 체결 (1) ㈜샤이나건설 외 1개사는 군사시설보호구역안에 위치한 파주시 B 일대 부지를 매입하여 공동주택건설계획을 추진하기로 하고서 그 부지의 일부로 2007. 6. 26. 피고와 피고 소유의 별지 목록 기재 부동산들을 매매대금 20억 원에 매수하는 토지매매계약에 앞서 토지매매약정(이하 ‘이 사건 매매약정’이라 한다)을 체결하였다.
