Punishment of the crime

On May 17, 2019, the Defendant was sentenced to imprisonment with prison labor for a violation of the Punishment of Violences, etc. Act (organization of an organization, etc.) at the Busan District Court, and the judgment became final and conclusive on November 29, 2019.

1. 피고인은 2019. 4. 13. 10:00경 부산시 사상구 학장로 268에 있는 부산구치소 제8수용동 B에서 C에게 D의 목을 조르도록 지시하였으나 제대로 조르지 않아 상대를 바꾸어 D에게 C의 목을 조르도록 지시하였으나 양손으로 목을 잡고 흔드는 시늉만 하자 “이 새끼들 봐라. 장난 같나, 똑바로 안하면 내가 너한테 한다.”라고 위협하며 C에게 D의 목을 조르도록 강요하여, C는 앉아 있는 D의 뒤에서 한 팔로 목을 감고 다른 팔로 감은 팔을 잡는 방법으로 힘을 주었고, D이 기절한 듯 팔을 늘어뜨리자 당황한 C가 D의 뺨을 두드리며 깨우자, C에게 “연기하는 거다. 똑바로 해라, 아니면 네가 당할 줄 알아라.”라고 위협하며 재차 D의 목을 조르도록 강요하였다.

2.
