A defendant shall be punished by imprisonment for not less than one year and six months.

Punishment of the crime

On June 20, 2013, the Defendant was sentenced to eight months of imprisonment for embezzlement at the Sung-nam branch of the Suwon District Court, and the said judgment became final and conclusive on January 17, 2014.

1. Fraud;

A. On November 4, 2009, the Defendant, without any intention or ability to complete payment to the victim C, received from the victim C a sum of KRW 50 million, which is the same day, KRW 25 million, and KRW 25 million around October 27, 2010, and KRW 50 million.

B. The Defendant, without any intent or ability to pay the victim F, is entitled to pay the principal after a year, with interest of 2% per month if he/she lends the victim KRW 150 million to the victim on October 26, 2010.

“Around that time, the Defendant received a total of KRW 150 million from the victim up to eight times (the Defendant provided a commercial building in Jung-gu, Seoul, as collateral, but there was no adequate collateral value because of its substantial value). (ii) On June 20, 2011, he provided a telephone to the victim and provided the victim with the interest of KRW 30 million,00,000,000,000,000,000,000,000). Accordingly, he received KRW 20,50,000 from the victim and acquired the money from the victim, respectively.

C. The Defendant’s fraud with the victim G is without any intent or ability to repay the amount. (1) On November 5, 2010, at the office located in Sung-nam-si, Sung-nam-si, Ho-si, which is operated by the Plaintiff, the Defendant would pay the victim G interest of KRW 2.5% per month if he/she lends KRW 100,000 to the victim G, and then pay the interest of KRW 2.5% per month.

‘Around that time, I would like to receive KRW 97.5 million from the victim as a loan, and (2) around December 9, 2010, I would like to additionally lend KRW 100 million to I to the artist at the above office.
