Reasons
Punishment of the crime
1. From June 2013 to June 9, 2016, Defendant A opened a gambling site with his/her name influence, Defendant A opened a gambling site F at an online gambling site at an influence place, and operated an illegal gambling site through the Internet to gambling, such as Bara, Lo-ro, Back, and slot machines. The Defendant was recruited to receive 30% of the money that he/she lost, and received 33,970,900 won by advertising the above gambling site on the various Internet community bulletin boards.
As a result, the defendant, in collusion with the influence of name, opened gambling for profit.
2. No person who violates the Electronic Financial Transactions Act shall issue instructions for transactions in electronic financial transactions or take over cash cards and their passwords or other access media which are the means or information used to secure the authenticity and accuracy of users and the details of transactions;
A. Nevertheless, around June 2014, the Defendant: (a) paid 1.5 million won to a person whose name is unknown at the Defendant’s home located in Seocheon-gu, Seocheon-gu G Apartment-gu, 412 Dong 1202; and (b) acquired the cash card of the SC Japan bank account in the name of H through Kwikset Services, a password of an official certificate, and an OTP card, etc.
B. On September 20, 2015, the Defendant paid 2 million won to a person whose name is unknown at the above Defendant’s home, and acquired the passbook, cash card, official stamp password, OTP card, and the passbook, cash card, official stamp password, and OTP card in the name of Kwikset Service to a national bank account in the name of Kwikset Service.
Accordingly, the Defendant acquired access media from another person.
3. On January 1, 2016, the Defendant’s gambling Internet using computers at the Defendant’s house located in Seocheon-gu Seoul Special Metropolitan City, Seocheon-gu G apartment 412 Dong 1202.
