A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

피고인은 2017. 2. 1. 경 서울 동대문구 C에 있는 전 연인이었던 피해자 D( 가명, 여, 22세) 의 집에서, 피고인이 사귈 때 갖고 있던 보조 열쇠를 달라는 피해자의 요청으로 술에 취해 피해자를 찾아갔다가 갑자기 피해자에게 성관계를 요구하였고 피해자가 이를 거부하자, 불을 끄고 자려고 누운 피해자의 배 위에 올라 타 양손으로 피해자의 양쪽 어깨를 눌러 반항을 억압한 다음 입으로 피해자의 왼쪽 목을 물고 피해자의 바지를 벗긴 후 간음하려 하였으나 피해자가 울면서 ‘ 하지 말라’ 고 소리치자 술이 깨면서 범행을 스스로 중지함으로써 미수에 그쳤다.
