1. Defendant Labor Welfare Corporation shall receive KRW 30,000,000 from the Plaintiffs, and at the same time, attached Form 1.

Reasons

1. Judgment on the claim against the defendant Labor Welfare Corporation

A. In accordance with Article 92(1)3 of the Industrial Accident Compensation Insurance Act, Defendant Korea Workers’ Compensation and Welfare Service: (a) imposed a deposit for lease on a shop established by an affected employee; (b) concluded a lease contract with the lessor under the name of the lessor; and (c) collected a certain amount of interest on the deposit from the affected workers; (c) on April 1, 2014, as to the building listed in attached Table 1(2) between Defendant Korea Workers’ Compensation and Welfare Service and D (hereinafter “instant building”), the lessor, Defendant Korea Workers’ Compensation and Welfare Service, Defendant C, store operator, Defendant C, 30,000,000, monthly rent of KRW 700,000, monthly rent of KRW 100,000 from April 1, 2014 to March 31, 2016; and (d) concluded a lease contract with the Korea Workers’ Compensation and Welfare Service to receive KRW 300,000,000 from Defendant Korea Workers’ Compensation and Welfare Service.

Since that time, Defendant C operated a store in the instant building.

3) On January 30, 2015, the Plaintiffs are the respective real estate listed in the separate sheet No. 1 (hereinafter collectively referred to as “each of the instant real estate”).

(4) On February 5, 2016, the Plaintiffs concluded a lease agreement (hereinafter “instant lease agreement”) between the Plaintiff, the lessee, the Defendant Workers’ Compensation & Welfare Service, the store operator, the amount of KRW 30,000,00, and the contract period from April 1, 2016 to March 31, 2017, with respect to the instant building owned by the Plaintiffs, on the grounds that the ownership transfer registration was completed on the grounds of sale as of December 19, 2014.

The main contents of the instant lease agreement are as follows.

AB (hereinafter referred to as "leased") contract for the lease of real estate (the monthly rent) is extended, and the lessor is the lessor.
