The prosecution of this case is dismissed.

The accused and the victim of the facts charged are all students of the C University.

On March 11, 2016, around 01:26, the Defendant connects C University students and graduates from the Defendant’s dwelling in Seoul D 105 to the clinic “F” on the online community bulletin board of “E”, which is an online community website, using a computer, at the Defendant’s dwelling in Seoul D 105, to assign things.

Accordingly, the defendant abused the victim's reputation by disclosing false information through information and communications networks with a view to slandering the victim.

Judgment

The facts charged in the instant case are crimes falling under Article 70(2) of the Act on Promotion of Use of Information and Communications Network and Information Protection, Etc., which cannot be prosecuted against the victim’s express intent pursuant to Article 70(3) of the said Act. According to the records, since a written agreement was submitted on November 15, 2016 that the victim did not want punishment of the defendant after the public prosecution of the instant case was instituted, the public prosecution of the instant case is dismissed in accordance with Article 327 subparag. 6 of the Criminal Procedure Act, and is so decided as per Disposition (the victim is conditional agreement and the above punishment is not punishable).
