1. The plaintiff's claim is dismissed.

1. Basic facts

A. On August 200, the Defendant is a public bath (hereinafter “instant public bath”) with the trade name “monthly hot spring” from around 100 to around 200 to around 235-14 of the Chhosung-si, Phosung-si.

(2) On July 21, 2014, the Defendant and the Red Cross Co., Ltd. (hereinafter “Surgy”) concluded a contract (hereinafter “instant contract”) with the Defendant for the supply of 512,180,000 won per annum with the cost of energy use, such as gas charges, electricity charges, while supplying hot water using the gas boiler.

(4) The window shall perform ex post facto management and repair of defects in the instant facilities for three years from the date the Defendant conducted an inspection on the completion of installation, and the Defendant may refuse to pay the amount of money stated in paragraph (3) where the Defendant fails to perform ex post facto management and repair of defects.

⑤ The window guarantees that the Defendant supplies hot water using the instant facilities for the next three years, thereby paying not more than 204,872,000 won per annum for energy use costs, such as gas charges, electrical charges, etc., of the instant bath for the next three years, and that the Defendant pays the amount in excess of 204,872,000 won per annum, the Defendant shall compensate the Defendant for such excess amount.
