1. Defendant C trades the Plaintiffs on July 14, 201 with respect to each of the 1/2 shares of each of the real estate listed in the separate sheet.
Reasons
1. Basic facts
A. 1) The Plaintiffs, as married couple, are the real estate listed in the separate sheet from Defendant C (hereinafter “instant apartment”).
2) On July 26, 2020, when the instant lawsuit was pending by J, the Defendant C’s wife is Defendant C’s children, Defendant F and K are the cares of Defendant C, and Defendant F and K are the cares of Defendant C.
Defendant G is the husband of Defendant F.
B. The Plaintiffs and Defendant C’s sales contract and payment of down payment 1) The Plaintiffs and Defendant C agreed that the Plaintiffs purchase the instant apartment from Defendant C for KRW 1.898 billion (hereinafter “instant sales contract”) on July 14, 2017 (hereinafter “instant sales contract”).
The main contents of the contract are as follows. The buyer shall pay the purchase price as follows with respect to the sale of the above real estate under Article 1. The purchase price of KRW 1.898 million is paid at the time of the contract, the intermediate payment of KRW 125 million is paid at the time of the contract, and the intermediate payment of KRW 6.85 million is paid at September 1, 2017, and the remainder of KRW 1.088 million is paid at October 20, 2017. The seller receives the balance of the purchase price from the buyer and at the same time delivers all documents necessary for the registration of the purchase price and cooperates with the transfer registration, and the above real estate is delivered on October 20, 2017. The seller is a licensed real estate agent under a mutual agreement to repair the house at the time of the contract, and the real estate agent’s office is a licensed real estate agent’s office at the time of the remainder of two weeks prior to the remainder of the purchase price.
The draft of contract terms and conditions, such as the terms and conditions of the contract including the purchase price, and the special agreement, were prepared. Such terms and conditions were agreed upon with the Plaintiffs and K, and the Plaintiffs, while the draft of the sales contract was drawn up, shall list the amount of KRW 125 million to K as the contract deposit.
