The prosecution of this case is dismissed.

1. The Defendant, at around 07:10 on May 11, 2013, committed an indecent act by using the victim D (Nam, 21 years old), who was divingd with clothes, in the Crown-si, Gangwon-do, or the fourth male water surface of the fourth floor, in his/her hands, at around 07:10, the Defendant committed an indecent act.

2. The above facts charged are crimes falling under Article 11 of the former Act on Special Cases Concerning the Punishment, etc. of Sexual Crimes (amended by Act No. 1156, Dec. 18, 2012) and can be prosecuted only when a victim files a complaint under Article 15 of the same Act. According to the written agreement submitted to this court on August 8, 2013, the victim's withdrawal of the complaint against the defendant around August 14, 2013, which is after the prosecution of this case, is recognized. Thus, the prosecution of this case is dismissed pursuant to Article 327 subparagraph 5 of the Criminal Procedure Act.

It is so decided as per Disposition for the above reasons.
