A defendant shall be punished by imprisonment for not more than ten months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

From spring in 2011 to the beginning of 2013, the Defendant was dead with the Victim C (53 years of age, female) who was a woman, and began to gather and contact with the victim on January 2016.

1. Around January 6, 2016, the Defendant violated the Act on Promotion, etc. of Information and Communications Network Utilization and Information Protection, etc.: (a) made a phone call more than 100 times on the victim’s cell phone (E, F) at the victim’s cell phone located in Busan Dong-gu, Busan; (b) sent a text message “I wish to do so,” and “Isman,” and “Isman,” from that time to March 9, 2016, up to March 9, 2016, the Defendant sent a text message of 1,140 copies per day as indicated in the list of crimes in the attached Form; and (c) made the victim’s photographic image before the victim’s house reach the victim’s family, thereby making the victim feel uneasy that the victim will become the victim’

As such, the Defendant repeatedly sent text message images that cause apprehensions to the victim.

2. Intimidation: (a) on February 25, 2016, the Defendant continuously sent text messages at the same place as above and sent the text messages to the victim’s cell phone that the victim did not receive the phone and did not take the phone, thereby threatening the victim by sending the text messages by affixing a knife photograph together with the text messages, such as “Isle. Casle, Isle, Isle, Isle, Isle,” and “New News Agency,” etc.

3. On March 1, 2016, around 13:00, the Defendant: (a) removed the door board, sealphone, and water measuring instruments, in which the market price cannot be known because of the finding in front of the victim’s house located in the Geum-gu G of Busan, from March 1, 2016.

As such, the Defendant destroyed the property owned by the victim and harmed its utility.
