1. The defendant Samchi Co., Ltd. and Samchi Co., Ltd. jointly share KRW 334,355,516 and their importance.
Reasons
1. Basic facts
A. The status of the parties and the progress of the construction of new apartment in this case 1) The plaintiff is the five A Apartment-dong 299 households located in Jinju City (hereinafter "the apartment in this case").
(2) On October 17, 2012, 201, the trust term was set between the K non-Real Estate Trust Co., Ltd. (hereinafter “K non-Real Estate Trust”) and the Defendant land for the purpose of constructing the instant apartment on the ground, and concluding a trust agreement for the purpose of selling the instant land and the instant apartment as trust property, with respect to the land located outside 1,539m27m2 (hereinafter “instant land”) located in Gyeonggi-gun-gun, Gyeonggi-do during the trust term from September 1, 2012 to December 31, 2014.
After May 18, 2015, the above trust agreement was terminated in accordance with Article 25 of the above trust agreement, and the defendant Kuchidi and KB real estate trust agreed to handle all matters related to the new apartment construction project of this case as well as the termination of the above trust agreement.
Article 3 of the supply contract for the apartment of this case states, “If the project is a land trust business, and the trust contract concluded between the Defendant and the K non-real estate trust is terminated due to the expiration of the trust period, termination of selection, termination, etc., all rights and obligations of the seller, as the seller, shall be comprehensively transferred to the Defendant land, and all rights and obligations against the buyer of K non-real estate trust shall be comprehensively transferred to the Defendant land without any separate measure, such as modification of the contract.”
3) On September 27, 2012, Defendant 3 entered into a contract on the construction of each of the instant apartment units with the K non-real estate trust that was an executor under the said trust agreement between Defendant 3 and the K non-real estate trust that was an executor under the said trust agreement. (b) Defendant 3 concluded a contract on the construction of each of the instant apartment units on October 17, 2012.
