A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for two years from the date this judgment became final and conclusive.

Punishment of the crime

The defendant of "2012 Highest 2652" is the representative director of the (ju) D in Yeongi-gu, Chungcheongnam-gu, Chungcheongnam-gu, Chungcheongnam-gu, who runs the manufacturing business by employing 22 full-time workers.

1. An employer in violation of the Labor Standards Act shall, when a worker dies or retires, pay the wages, compensations, and all other money or valuables within fourteen days after the cause for such payment occurred, and may extend the due date by mutual agreement between the parties concerned in special circumstances;

Nevertheless, the Defendant did not pay KRW 6,753,103 in total, including three workers’ bonus, etc., as stated in attached Table 1, as well as KRW 297,949, which was retired from the said workplace on June 26, 2012 at the said workplace, for the extension of the payment deadline, 14 days from the date of retirement without agreement between the parties concerned.

2. An employer who violates the Guarantee of Workers' Retirement Benefits Act shall, in case where a worker retires, pay the retirement allowance within 14 days from the time when the cause for such payment has been issued, and where special circumstances exist, the period may be extended by mutual agreement between

Nevertheless, the Defendant did not pay 46,623,490 won, including the retirement pay 20,529,990 won, retired from the said workplace on June 26, 2012, to three retired workers, without agreement between the parties to the extension of the payment due date and 14 days from the date of retirement, as described in attached Table 1.

The defendant of "2013 Highest 743" is the representative director of the D Co., Ltd. located in Chungcheongnam-gu Seoul Metropolitan City, Chungcheongnam-gu, who runs the manufacturing business by employing 22 full-time workers.

1. If a worker in arrears dies or retires, the employer shall pay the wages, compensations, and other money or valuables within 14 days after the cause for such payment occurred;

Provided, That in special circumstances, the parties shall be free to exist.
