1. The Defendants jointly set forth KRW 31,872,820 as well as 5% per annum from December 3, 2014 to May 17, 2016.
Reasons
1. Facts of recognition;
A. The Plaintiff is the owner of Dobong-gu Seoul Metropolitan Government B Apartment 101 Dong 106 (hereinafter “instant apartment”), and the council of occupants’ representatives (hereinafter “Defendant Representative Council”) is the council of occupants’ representatives consisting of the apartment occupants belonging to the instant apartment, and the Defendant Dong-friendly Development Co., Ltd. (hereinafter “Defendant Co., Ltd”) is the housing facility managing entity entrusted with the management of apartment units by the Defendant Representative Council.
나. 피고 회사 소속으로 2009. 12.경부터 B아파트 관리사무소에서 근무하면서 전기 및 배관, 소방 시설을 직접 관리하는 업무에 종사하던 C는 2011. 12. 초순경 우수관 동파방지를 위해 이 사건 아파트 외부에 설치되어 있는 우수관에 열선을 감는 작업을 하면서 열선을 가위로 잘라 사용하고 그 끝부분의 마감 처리를 제대로 하지 않은 채 열선과 연결된 전원을 켠 과실로 2014. 12. 2. 01:30경 위 우수관 바깥쪽에 감아 놓은 열선에서 전기적 단락이 발생함으로써 화재가 발생하여 그 불길이 이 사건 아파트 내부로 번져 이 사건 아파트 내부가 소훼되었다

C On September 18, 2015, from the Seoul Northern District Court (2015dan1504), “The instant fire was caused by occupational negligence and the repair cost equivalent to KRW 102,952,145,145” was sentenced to a suspended sentence of 2 years in August due to the crime of occupational negligence.
The above judgment was finalized on January 12, 2016. D.
The insurer paid to the Plaintiff KRW 26,429,868, totaling KRW 16,429,868, and KRW 10,000,00,00,00 for the instant apartment building with fire insurance money.
At the time of concluding the fire insurance contract, the insurable value for the part of the apartment building of this case is 61,983,586 won, and the insurable value for the household building of this case is 29,401,141 won.
E. The apartment of this case is balcony among the sections of exclusive ownership without obtaining permission from the relevant authorities.
