Defendant shall be punished by a fine of KRW 3,000,000.

When the defendant does not pay the above fine, 100,000 won.

Punishment of the crime

[Presumption Facts] The Defendant, as an individual entrepreneur who is engaged in the business of selling stone in his trade name in Boan City, was sharing data on the design drafting of sculptures created by D and works installed therein from 2005 to August 2006, while engaging in a business related to D and sculptures.

The Defendant, while having a collaboration relation with D, manufactured and installed a sculpture in the same way as D in G apartment located in Kimpo-si around March 2009 and in Seoul H apartment in the same way as D created in the same manner, he manufactured and installed the sculpture in the same manner as D, respectively.

Since then, D filed a lawsuit claiming damages against the Defendant at the Goyang District Court, and F was present at the above court as a witness on December 18, 2014, and the sculpture G apartment, etc. was manufactured and installed by receiving photographs from the Defendant.

On August 20, 2015, the court testified that D shall pay damages of KRW 15 million to D.

[2] On December 2015, the Defendant prepared a false complaint against F in the future at the International Attorney Office located in Seocho-gu Seoul, Seocho-gu, Seoul, for the first time in the Seocho-gu Office of Police Station.
