Reasons
Punishment of the crime
[criminal record] On May 23, 2018, Defendant B was sentenced to one year to a suspended sentence of four months of imprisonment for a crime in the military branch of the Jeonju District Court for the purpose of fraud, and the judgment became final and conclusive on May 31, 2018.
[Criminal facts]
1. Defendant A and B conspired to receive insurance money by receiving the insurance company’s accident contents after receiving the insurance company’s accident and receiving the repair cost, if the Defendants conduct the front and rear by using the vehicle for the purpose of raising business funds and living expenses, as agreed by the preceding vehicle.
On July 11, 2017, at around 19:30, the Defendants: (a) drive a K rocketing motor vehicle on the roads of J.S., J., J., J., J., J. B; (b) Defendant A received the insurance money from the victim LM5-type accident on July 12, 2017, to the effect that the said accident was caused by negligence in accordance with the Victim LM5-type Non-Life Insurance Act; (c) Defendant A paid the total amount of KRW 1,450,00,000,000,000,000,000 won, from July 13, 2017 to August 30, 2017, the Defendant paid the total amount of KRW 1,450,000,000,000,000,000,000 won.
Accordingly, the Defendants acquired insurance money by deceiving the cause of the insurance accident against the victim's lot accident insurance.
2. Defendant A, B, and C committed joint crimes with a view to raising business funds and cost of living, the Defendants used the vehicle in front and rear, and conspired to receive insurance proceeds by receiving the insurance company’s accident contents after the occurrence of an intentional accident that leads minorly in the future, and then receiving the repair cost of the vehicle.
In accordance with the above public offering, the Defendants’ housing units in the Yeong-gu, Yecheon-gu, Seoul Special Metropolitan City around August 9, 2017 are front.
