Punishment of the crime

Defendant

A is the representative director of C Co., Ltd., Defendant B is the director of the building division of C Co., Ltd., and Defendant C Co., Ltd is a corporation established for the purpose of housing construction, civil engineering and building business.

Any person who intends to cut standing timber or extract or gather forest products in forest fires shall obtain permission from the head of a Si/Gun/Gu or the head of a regional forest office, as prescribed by Ordinance of the Ministry of Agriculture, Food and Rural Affairs

The same shall also apply where he/she intends to revise any important matter prescribed by Presidential Decree among permitted matters.

Nevertheless, Defendant A and B conspired to mine out, without permission of the competent authority, part 8 of heavy equipment, part 8, and one copy of kump tree for the purpose of obtaining a building permit by lowering the full-time capital in D forest land at the end of February 2015.

In addition, Defendant C corporation had Defendant A and B commit an act of violation at the same time and at the same place in connection with the Defendant’s business.
