1. The defendant shall be the plaintiff.

(a) Of the real estate listed in paragraph 1 of the attached list, the Attached Form Nos. 2, 12, 15, 16, and 2.

Reasons

1. The following facts can be acknowledged in full view of the records in Gap evidence Nos. 1 and 5, and the results of the survey and appraisal commissioned to the Seoul Northern Vice-Governor of the Korea National Land Information Corporation to the Seoul Northern Vice-Governor of the Korea National Land Information Corporation:

On January 4, 2001, the Plaintiff completed the registration of ownership transfer with respect to the real estate listed in the attached list No. 1 (hereinafter “Plaintiff’s land”).

B. On June 23, 1995, the Defendant completed the registration of ownership transfer concerning the real estate listed in paragraph (2) of the attached Table No. 2 (hereinafter “Defendant building”).

피고 건물 1층 침범 부분 토지인 위 선내 ㈎ 부분 13.3㎡에 대한 2007. 6. 23.부터 2017. 11. 23.까지의 임료 합계는 17,023,000원이고, 2017. 11. 23. 현재의 연 임료는 1,570,000원이다.

2. Determination

A. According to the above findings of the determination as to the cause of the claim, the defendant is obligated to remove the part of the defendant's building 1 and 2, which affected the plaintiff's land, among the defendant's building, and deliver the part of the land of the first floor of the defendant's building to the plaintiff.
