피고인은 강원도 민회 모임에 참석하여 C 식당에서 저녁 식사를 하며 피해자 D( 가명, 여, 51세 )에게 러브 샷을 수회에 걸쳐 요구하였으나 거부당하고 2차로 여주시 E에 있는 F 주점으로 자리를 옮기게 되었다.

피고인은 2017. 7. 14. 18:00 경 위 주점에서 피해자의 옆자리에 앉아 러브 샷을 요구하고 이를 피해 자리를 옮기는 피해자의 옆자리로 다시 옮겨 앉은 후 피해자에게 몸을 밀착 시고 러브 샷을 요구하며 피해자 왼쪽 겨드랑이에 손을 넣어 옆구리를 아래위로 만지고, 팔짱을 끼는 척하면서 왼쪽 허벅지와 엉덩이 등을 만졌다.

When comprehensively considering the Defendant’s age, occupation, risk of recidivism, type, motive, process, seriousness of the crime in this case, the degree and expected side effects of the Defendant’s disadvantage due to the disclosure order or notification order, the preventive effect of the sexual crime subject to registration that may be achieved therefrom, and the effect of protecting the victim, the Defendant shall be punished for sexual crimes.
