1. The defendant shall be the plaintiff.

The following facts may be found either in dispute between the parties or in Gap evidence Nos. 1, 2, 3, 4, 5, Eul evidence Nos. 6 (except for the part in the name of C), Eul evidence Nos. 1, 2, 3, Eul evidence No. 4-1, Eul evidence No. 4-2 (except for the part in the name of the plaintiff and C), and Eul evidence No. 4-3 (except for the part in the name of the plaintiff and C).

(1) On January 23, 2014, the Plaintiff entered into a lease agreement between the Defendant and the Defendant, setting the lease deposit of KRW 10 million, monthly rent of KRW 1,300,000, and the lease term of February 25, 2019, with regard to the real estate listed in the separate sheet (hereinafter “the lease object of this case”).

(2) At the time of the conclusion of the instant lease agreement, the registration of the entry of the decision on compulsory commencement of auction on the instant leased object was completed with the District Court D with regard to the instant leased object.

(3) Before the instant lease agreement, the Plaintiff notified the Defendant of the existence of each provisional attachment registration, the registration of the entry of the compulsory auction commencement order, the provisional registration of the right to claim ownership transfer, and the registration of the establishment of a neighboring mortgage.

B. (1) The Plaintiff entered into a lease agreement with the Plaintiff and C Co., Ltd. (hereinafter “C”) on January 23, 2014, with the Defendant’s E management Co., Ltd. (hereinafter “C”), and with respect to subparagraph 109, which is linked to the leased object of the instant lease, a lease agreement with the Plaintiff as to the lease deposit of KRW 15 million, monthly rent of KRW 1300,000,000, and the lease term of KRW 109,000,000,000,000 won, monthly rent of KRW 100,000,000,000, and the lease term of February 25, 2019 (hereinafter “lease”).
