A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

On April 15, 2008, the Defendant was issued a summary order of KRW 1 million by the same court as a crime of violating the Road Traffic Act (drinking driving) in the Goyang Branch of the Jung-gu District Court on April 15, 2008 and a fine of KRW 2 million by the same court on October 26, 2017.

Criminal facts

1. On January 8, 2018, the Defendant violated the Road Traffic Act (drinking) and the Road Traffic Act (drinking without a license) driven two or more times as above, and driven B rocketing car while under the influence of alcohol content of about 0.110%, without obtaining a driver’s license, at the section of about 7km from the front of the Dong-dong Hospital located in the Dong-dong-dong-gu, Busan National University on January 27, 2018 to the long distance prior to the entry of the 1562-4, Japan-dong-dong, Japan-dong.

2. The Defendant, who violated the Act on Special Cases Concerning the Settlement of Traffic Accidents (Bodily Injury) is a person engaging in driving service of the said rocketing car;

Defendant 1 driven the said car while under the influence of alcohol concentration of 0.110% in blood during the day of the foregoing day, and led to the driving of the said distance to the Sinsan Mental City on the side of the Hosi-dong.
