A defendant shall be punished by imprisonment for six months.

Punishment of the crime

On June 20, 2018, around 21:10, the Defendant driven a Cwing and 1 ton cargo vehicle in the state of alcohol alcohol level 0.129% from the 5km section of alcohol level to the front side of the office in front of that office, from the 5km section, when the Defendant was under the influence of alcohol level 0.129% from the 5k section of the 5k section in front of that office.

Although the Defendant was subject to a fine for this, the Defendant had been subject to driving under the influence of alcohol again, and the blood alcohol concentration at the time of the instant crime is considerably high.

It is not reasonable to sentence a fine or a suspended sentence of imprisonment with labor, considering the circumstances favorable to the defendant, or the defendant's damage caused by drinking alcohol, in light of the fact that the defendant's mistake is against himself/herself, and that considerable time has elapsed from the past crime to the crime of this case.

Therefore, the sentence of imprisonment with prison labor shall be imposed on the accused, and the sentence shall be determined as ordered by comprehensively considering the favorable circumstances of the accused as seen earlier, the age, occupation, sex, family relationship, and various sentencing conditions as shown in the trial process, such as the records and circumstances before and after the crime.
