All appeals by prosecutors are dismissed.

1. Summary of grounds for appeal;

A. The sentence imposed by the lower court on the Defendant (eight months of imprisonment) is too unreasonable.

B. The sentence imposed by the prosecutor by the court below is too uneasible and unfair.

2. The appeal by the accused and the public prosecutor shall also be considered to be filed;

Recognizing the following circumstances: (a) the Defendant led to the instant crime; (b) the Defendant’s withdrawal of the accusation against H by an investigative agency; and (c) criminal punishment or disciplinary action against H did not occur; and (c) the Defendant appears to have not completely settled his/her claim and obligation relationship over a long period of time between the Defendant and H.

However, it is highly probable that the crime without prejudice to the criminal justice function of the State and is likely to be subject to a criminal punishment or disciplinary action against H. Although the crime of this case does not appear to have been committed only with the purpose of criminal punishment or disciplinary action against H. However, there is considerable doubt as to whether the criminal of this case was committed due to a simple error from the investigative agency to the trial, and rather, the defendant seems to have committed the crime of this case, which is contrary to the truth. On July 12, 2012, the defendant was sentenced to two years of imprisonment with prison labor for the same criminal as the Busan District Court, for the same crime of aiding and abetting the criminal, etc. on June 30, 2014, which committed the crime of this case again during the period of the repeated crime, even after the execution of the sentence was completed, and all of the sentencing conditions of the defendant, such as age, character and environment, environment, motive, means and method of the crime, circumstances after the crime, etc., and the scope of punishment without self-denunciation or sentence (special sentencing guidelines).
