A defendant shall be punished by imprisonment for six months.

Punishment of the crime

On April 25, 2007, the Defendant issued a summary order of KRW 1.5 million at Seoul Southern District Court; on June 12, 2007, the Seoul Southern District Court issued a summary order of KRW 2.5 million due to a violation of the Road Traffic Act (driving) at Seoul Southern District Court; on February 26, 2015, the Seoul Southern District Court issued a summary order of KRW 5 million as a fine of KRW 1.5 million (driving).

On February 20, 2018, the Defendant, who violated the duty of prohibition of driving under the influence of alcohol two times or more, once again, driven the Ebenz car at the 1km section from the front of the C restaurant located in Gyeyang-gu Incheon Metropolitan City to the front of the Incheon Gyeyang-gu apartment, while under the influence of alcohol level of 0.104% under the influence of alcohol level around 23:16.

Summary of Evidence

1. Police suspect interrogation protocol of the accused;

1. Report on the circumstantial statements of a drinking driver, and the results of the control of drinking driving;

1. Application of Acts and subordinate statutes to criminal records, repeated statements, and copies of each summary order;

1. Articles 148-2 (1) and 44 (1) of the former Road Traffic Act (Amended by Act No. 16037, Dec. 24, 2018; Act No. 16037, Jun. 25, 2019);

1. Selection of imprisonment with prison labor chosen;

1. Determination of the same sentence as the disposition of the instant case, including the reason for the sentencing under Articles 53 and 55(1)3 of the Criminal Act, the background of the drunk driving, the measured level of drinking alcohol, the previous conviction of a fine for drunk driving and three times, etc., taking into account the overall conditions of sentencing as shown in the pleadings

It is so decided as per Disposition for the above reasons.
