A defendant shall be punished by imprisonment for one year.

1. 아동ㆍ청소년의성보호에관한법률위반(강제추행) 피고인은 2019. 2. 27. 01:30경 서울 양천구 B아파트 C동 건물 뒤 공터에서, 피해자 D(여, 13세, 가명)이 아는 동생에게 버릇없이 굴었다는 이유로, 손으로 피해자의 목을 조르고 뺨을 수회 때린 후, “옷벗어”라고 하여 피해자로 하여금 하의 속옷까지 모두 벗게 하고, 손으로 피해자의 허벅지 뒷부분을 만지고 피해자의 가슴을 움켜쥐고 흔들고, 피해자의 음부를 문지르고, 피해자의 배를 발로 수회 찼다.

As a result, the defendant committed indecent acts against the child or juvenile victim.

2. 협박 피고인은 위 1항 기재 일시, 장소에서 피해자의 벗은 몸을 휴대전화로 촬영하는 시늉을 하고, 같은 날 01:47경 피해자의 휴대전화를 이용하여 “A 오빠 저 조건 돌고 싶어요 저 요즘 너무 꼴려서”라는 문자메세지를 피고인의 휴대전화로 전송하여 마치 피해자가 피고인에게 성매매를 하고 싶다는 문자메세지를 전송한 것처럼 꾸민 후, 피해자에게 "경찰에 신고하면 사진을 뿌려버리고 문자메세지를 보여준다"라고 말하여 피해자를 협박하였다.
