1. On March 20, 2017, the Defendant, from the Plaintiff, filed with the Suwon District Court in relation to the real estate stated in the attached list.

Reasons

Basic Facts

On February 15, 2017, the Plaintiff leased real estate listed in the separate sheet (hereinafter “instant apartment”) from C with the lease deposit amount of KRW 220,00,000,000, and the lease term of KRW 220,000 from March 20, 2017 to March 19, 2019 (hereinafter “instant lease agreement”). By March 20, 2017, the Plaintiff paid C the entire lease deposit (as down payment of KRW 22,00,000,000, and the remainder of KRW 198,00,000,000 on March 20, 2017) to C, and was delivered the instant apartment from C around that time.

On March 20, 2017, the Plaintiff completed the registration of the establishment of chonsegwon (hereinafter “registration of the establishment of chonsegwon”) with the term of the above lease deposit as the security deposit by the Suwon District Court, Seosung District Court No. 55654, Mar. 20, 2017, which was received on March 20, 2017.

On September 22, 2018, the Defendant: (a) purchased the instant apartment from C in KRW 229,00,000 (hereinafter “instant apartment purchase contract”); (b) agreed to succeed to the lessor’s status under the instant lease agreement; and (c) completed the registration of ownership transfer in its name with respect to the instant apartment on October 5, 2018.

On February 6, 2019, one month prior to the expiration date of the instant lease agreement, the Plaintiff expressed to the Defendant that he/she was not willing to renew the instant lease agreement after the expiration of the lease term, and on May 22, 2019, the Plaintiff again expressed to the Defendant that he/she would be entitled to receive the refund of the lease deposit from the end of June 2019.

After that, the Plaintiff applied for the order of lease registration as the Suwon District Court 2019Kadan581 and received the order of lease registration on December 5, 2019.

Accordingly, on December 18, 2019 with respect to the apartment of this case, on the ground of the above order of lease registration on the ground of the above order of lease registration was completed on December 18, 2019, the registration of the lease of the house was completed on December 18, 2019.

On January 31, 2020, the Plaintiff moved out from the apartment of this case.
