Reasons
Punishment of the crime
1. Defendant A
A. From June 3, 2013 to December 19, 2013, the Defendant leased C’s cultural heritage repair engineer qualification certificate to use C, by leasing cultural heritage repair engineer qualification certificate from C, who is a cultural heritage repair engineer in the field of repair, to four sites of cultural heritage repair work, such as G repair work, H repair work, I repair work, and J repair work, which was ordered by B, and posting C as a field agent in document form.
B. From February 1, 2013 to October 23, 2013, the Defendant leased and used K’s cultural heritage repair engineer qualification certificate by leasing the cultural heritage repair engineer qualification certificate from K, which is a cultural heritage repair engineer in the field of repair, and placing K in four sites of repair works, such as L repair works, M repair works, N repair works, and O repair works, which were received by B, in document form.
2. Defendant B Co., Ltd. leased and used each cultural heritage repair engineer qualification certificate from C and K with respect to the Defendant’s duties at the date, time, place, as described in the foregoing paragraph (1).
3. From June 3, 2013 to December 19, 2013, the Defendant leased the cultural heritage repair engineer qualification certificate to A, such as having A formally assign the Defendant to the four cultural heritage repair work site where B corporation received orders using the Defendant’s cultural heritage repair engineer qualification certificate in the field of repair and maintenance work.
