Punishment of the crime

[Presumption of Facts] The defendant is a person who works as a director of F's leader of corporation F in Busan Seo-gu E, and the victim G is a representative director of the above company.

As above, the Defendant supplied workers at the construction site while working as the warden, and paid to the workers who completed the work on the day by receiving the remainder after deducting 10% of the introduction fee from the victims every day for the daily wage of the supplied workers.

The details of the Defendant’s human resources supply work are as follows: (a) if the Defendant actually supplies workers at the construction site, if the Defendant inputs the name and site location of the construction company, personal information of the on-site human resources manager and workers in the human resources management program operated by F Co., Ltd. from the above leader office, the Defendant is transferred to the victim’s account in advance after deducting 10% fee from the head office of F Co., Ltd., and then submitted to F Co., Ltd. with the signature of the person who then printed out the above contents of the entry into a daily statement and entered them into the human resources management manager at the construction site; and (b) upon the completion of the construction site, the Defendant prepares a wage application form based on the daily statement in which the Defendant entered

However, the Defendant, based solely on the fact that the victim and the head office of the FF, as above, entered the Defendant’s computer and the daily output list signed by the human resources management manager at the construction site, paid daily wages to the employees to him/her in advance, and then, did not immediately confirm whether the workers were supplied to the actual construction company due to the claim for wages after approximately 1 to 2 months. In addition, the false construction site and false workers were entered into the said human resources management program and the daily output list.
