1. Basic facts

A. One general building registration and 14 aggregate buildings registration have been completed in relation to the C Commercial Building (hereinafter “C Commercial Building”) which is a building constructed on the 16th parcel of Seoul Jung-gu E, F, G, H, I, J, K, L, M, P, P, P, Q, R, S, and T 16 lots of land in Jung-gu, Seoul. However, each of the above registrations does not properly reflect the current status of the building by using the existing registration after the expiration of 2005, where only the size of the building is written or the site registration is not made without any specific specification, such as the unit registration of the building in the section for exclusive use.

B. On the land that constitutes a site of the C commercial building, the co-ownership registration of each shop owner, etc. as co-owner is completed. Defendant B owns 40/160.8 shares and RR 51.9 square meters out of Qgu Seoul, Jung-gu, Seoul, as part of the site, and 40/160.8 square meters out of Qua 30.7 square meters.

C. Around November 2, 2010, X, the husband of the Defendant owned 40/160.8 shares (hereinafter “instant land share”) among 40/160.8 square meters in Jung-gu, Seoul (hereinafter “the instant land”), but the Plaintiff purchased the said land share in the voluntary auction procedure (hereinafter “AA”) and completed the registration of ownership transfer under Article 5286 of the receipt of the said land share on November 11, 201.

Defendant C branch office (hereinafter referred to as “branch office”) is an unincorporated association established for the purpose of performing the management affairs of land and building, such as receiving rent from the lessee of the store that has been entrusted with the management of the member and distributing it to the member.
