A defendant shall be punished by imprisonment for four months.

However, the execution of the above punishment shall be suspended for one year from the date this judgment becomes final and conclusive.

Punishment of the crime

1. A person who intends to engage in development activities shall obtain permission for development activities from the head of the competent Gun, and the same shall apply to any revision to permitted matters;

Nevertheless, from March 7, 2012 to March 7, 2013, the Defendant collected earth and rocks with permission to collect earth and rocks on the lots other than Da, E, F, G, and G, which are located near the permitted place, and collected earth and rocks from 5,170 cubic meters in cubic meters without obtaining permission for change.

2. A person who has obtained permission for development activities from the head of a Gun shall, upon completion of such development activities, undergo a completion inspection.

Nevertheless, the Defendant did not undergo a completion inspection after the lapse of the period of permission on March 31, 2013, and did not follow an order to undergo a completion inspection on three occasions from August 31, 2013 to March 24, 2014.

3. Where any person who has obtained permission for development activities performs development activities differently from the details of permission, and thus an order to reinstate is issued, he shall comply therewith.

Nevertheless, the Defendant failed to comply with an order to reinstate, even though he/she received an order to reinstate the area three times from August 14, 2013 to March 25, 2014 from Go Chang-gun.
