1. The defendant shall be punished by imprisonment with prison labor for not more than ten months;
2.Provided, That the above sentence shall be executed for a period of two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. A person who intends to run a general game providing business providing game apparatus which is not classified as an unauthorized business or rating may conduct a business with the permission of the head of a Si/Gun/Gu, and no person shall provide the distribution or use of game apparatus which has not been classified, or display or store for such purpose;
Nevertheless, on July 14, 2017, the Defendant established 21 game machine for “Gu slot machine” without obtaining permission from the head of the Gu of Nam-gu, Nam-gu, Nam-gu, Gwangju-si and operated a game providing business by allowing many unspecified customers to use the game machine from that time until September 14, 2017.
Accordingly, the defendant operated a general game providing business without obtaining permission from the head of the Gu, and provided the game water that was not rated.
2. No one shall allow anyone to gamble or perform other speculative acts by using game water, or leave him/her to do so;
Nevertheless, from the early July 2017 to September 14, 2017, the Defendant: (a) granted 10,000 won to the above game room to the customers who found the place; and (b) granted 2,000 won to the game machine; and (c) lost or obtained the points according to the result of the game run, the Defendant, upon receiving a request for return according to the accumulated points, accumulated the above points on the bearer card in the name of the immediately after the receipt of the request for return; and (b) granted the accumulated points on the card in the game machine to the customers, and made them possible for customers to resume the said card without any other confirmation; and (c) granted the exchange value to the said card to customers by selling the said card to other customers at an irregular place.
Accordingly, the defendant uses game water to customers who found the above game room.
