A shall be punished by imprisonment with prison labor for eight months and by imprisonment for six months.
Reasons
Punishment of the crime
[criminal records] Defendant A was sentenced to two years and eight months of imprisonment for fraud, etc. at the Suwon Fagwon on June 12, 2015, and the above judgment became final and conclusive on June 15, 2015.

B On December 10, 2014, the same court was sentenced to 10 months of imprisonment due to fraud, etc. and the above judgment became final and conclusive on December 18, 2014.
[2] The Defendants and E (the Defendant’s dismissal of appeal and dismissal of appeal after he/she was sentenced to three years and six months of imprisonment on July 7, 2015) are corrected as stated above, ex officio, by correction.
On March 4, 2014, F (amended by Act No. 10, Oct. 2, 2014; Act No. 110, Nov. 28, 2014) opened a mobile phone sales agent in the name of “G” and proposed F to receive and obtain a mobile phone supply from a mobile phone retailer or retailer in the name of “G” and approved by F. Defendant A and E, and the Defendants conspired to sell the mobile phone in the form of “B” under the direction of E, in which the Defendants do not open a direct transaction with the Dor and retailer and to sell the phone in the form of “B”.
Defendants and E made a false statement to the effect that, around March 8, 2014, at the above G stores located in Ansan-gu, Mayang-si, Ma, Defendant A opened a portable phone store which he/she secured, and that, “The sales of the mobile phone store would settle the price by selling it if he/she would supply the portable phone store and the core card.”
However, in fact, the Defendants and E were supplied with a portable phone agent’s portable phone call and expected to dispose of it at a low price to the distributor, and thus, they did not have any intent or ability to pay the price to the victim by selling it normally to many and unspecified customers.
Defendants in collusion with E and by deceiving the J as such, 36 mobile phone calls (31.31.31.) equivalent to the total market value of 31,826,300 won from victim I on the same day.
