1. Defendant A

A. The Defendant in violation of the Occupational Safety and Health Act is a person who acts on behalf of a business owner as a site manager at the E Park Creation Work site located in D in the original city, the main office of which is located in the Chuncheon City C building.

The business owner shall install protective measures, such as a rail, at a place where workers might fall down, and shall take measures necessary for the prevention of danger, such as the installation of proper slot equipment or posting monitors, if the business owner projectes an object from a place where height is at least three meters.

Nevertheless, at around 13:40 on September 10, 2013, the Defendant, at the above construction site, engaged in the work of a worker F to get a combined plate down at the level below 3 meters from the excavated site, and did not take a fall preventive measure and did not install a cooling system, thereby falling the said F at a level below 3 meters from the crop and falling the head into a concrete pipe, thereby causing the death of around 14:30 on September 14, 2013.
