1. The Defendant shall pay to the Plaintiff KRW 51,494,775 and the interest rate of KRW 15% per annum from December 20, 2018 to the date of full payment.
Reasons
1. Determination as to the cause of claim
A. The Plaintiff, at the construction site requested by the Defendant, leased temporary materials, such as water pumps, pipes, sprinks, sprinks, softs, and safety launch plates, to the Defendant. 2) From June 15, 2015 to November 18, 2016, the Plaintiff leased the temporary materials to the Defendant at the construction site “FJ in E” and there was KRW 143,797,830 as rent. The Defendant paid only KRW 114,00,00 out of the above rent to the Defendant, but did not pay KRW 29,797,830 to the Plaintiff.
3) From November 20, 2015 to May 31, 2016, the Plaintiff leased the temporary materials to the Defendant at the construction site of “Sari-si” site and incurred KRW 18,451,395 as the rent. The Defendant did not pay the Plaintiff the remainder of 18,068,595 won, subtracting the purchase price of KRW 382,80 from the above rent. 4) From November 3, 2015 to November 21, 2015, the Plaintiff leased the temporary materials to the Defendant at the construction site of “Sapo-si H” site of “Sapo-si, Gan-si,” and the amount of KRW 3,706,450 as the rent. The Defendant did not pay the Plaintiff the remainder of KRW 78,100 deducted from the purchase price.
5) On June 27, 2016, I possessed the name of the vice president of the Defendant Company: (a) jointly and severally with the Defendant, to pay 6,494,775 won in the balance of the temporary site rent as of June 27, 2016 used at each of the above construction sites and the J sites for five months from July 30, 2016; (b) the amount may be partially adjusted and discharged (50,000,000 won in the settlement of accounts). B. According to the above facts of determination, the Defendant’s remaining rent of KRW 51,494,775 (=29,797,830 won) and the Defendant’s rate of KRW 15% per annum from December 20, 2018 to the date of full payment, which is the day following the delivery of the original copy of the instant payment order, sought by the Plaintiff.
