피고인은 2013. 10. 26. 20:10경 광주 남구 진월동에 위치한 광주은행 365코너 앞 노상에서 주ㆍ정차위반 지도 단속을 하고 있는 광주남부경찰서 B지구대 소속 경찰관인 피해자 C의 행위에 불만을 품고 그 곳에서 성명불상의 뻥튀기 행상과 다수의 통행인들이 있는 가운데 ‘이 짭새 새끼가 몰래 단속하고 다닌다. 이 새끼가 서민들을 단속하고 다닌다. 야, 새끼야 그러면 안 돼, 개새끼야'라고 큰 소리로 말하여 공연히 피해자를 모욕하였다.
