A defendant shall be punished by imprisonment for not less than eight months.
Reasons
Punishment of the crime
From January 2005, the Defendant has been working as a village of Gyeonggi-gu, Gyeonggi-do from January 2005 to the present.
1. Fraud and occupational breach of trust;
A. On June 1, 2007, the Defendant sold to H the Defendant’s house located in Gyeonggi-gu, Gyeonggi-do, the aggregate of 106,219,200,000 square meters in the name of the D Saemaeul Association, F. 602 square meters in total, G forest land, and 826 square meters (hereinafter “this land”) at H. The Defendant sold to H, as the head of the village, the village, in violation of the duties that should be sold at an appropriate price with the consent of all residents, and sold to KRW 30,000,000 at his own discretion without the consent of all residents. On June 4, 2007, the Defendant arbitrarily prepared the “D Saemaul Association Regulations” and the “D Saemaul Association Resolution and Resolution Resolution” prepared by the Defendant, and completed the registration of ownership transfer from H for the land title trust.
As a result, the Defendant obtained H the pecuniary advantage of KRW 106,219,200, and suffered damage equivalent to the same amount of the D Saemaeul Association.
B. On September 5, 2006, the Defendant: (a) committed a crime of cutting standing timber in the name of J without permission to convert a mountainous district; (b) committed a violation of the Management of Mountainous Districts Act; (c) a violation of the Creation and Management of Forest Resources Act; (d) a violation of the Creation and Management of Private Documents; (d) a violation of the Private Document 160; and (e) a violation of the Private Document 219 (Merger) on November 5, 2007, a fine of KRW 5,00,000; and (e) a fine of KRW 8,000,000; and (e) a fine of KRW 8,000; (e) an attorney’s appointment fee of attorney-at-law; and (e) a violation of the Management of Mountainous Districts Act; (e) a violation of the Private Document ; and (e) a violation of the said Act; and (e) a violation of the said Act.
