1. The defendant's law firm Samduk Law Firm, 2007, No. 100, Jan. 16, 2007 against the plaintiff.
Reasons
1. Around September 10, 2006, Nonparty C joined one unit of 52.5 million won (1.5 million won, after the receipt of the monthly payment, 2.00 million won) and 35 unit of 35 unit of accounts (hereinafter “instant accounts”). Around January 10, 2007, Nonparty C received the fraternity payments, and on January 16, 2007, prepared and executed a notarial deed (hereinafter “notarial deed of this case”) with the Defendant as a joint and several surety on January 16, 2007, in order to guarantee the Defendant’s obligation to pay the remaining installments (2 million won and 30 months in total).

2. The plaintiff asserts that all of the fraternity payments of this case were made. Thus, according to the statements in the evidence Nos. 3 through 9, 12, and 13, it is acknowledged that the plaintiff or C paid KRW 1,7520,000 (the sum of KRW 1,7520,000 (the sum of KRW 920, G200, KRW 450, KRW 100,000, KRW 12,14, 15, 18, 2020, 21, 23, 26), and KRW 29,000,000 (the sum of KRW 1,45,000, KRW 1,000, KRW 230,000, KRW 230,000 among the statement of remittance in the attached Form) to the defendant.
In addition, the plaintiff asserts that he remitted 14 million won to the above D and E passbook as the above D and E's passbook (the remittance statement in the attached Form Nos. 2, 3, 5, 13, 16, 17, 19, 22, 24, 25, and 27 among the remittance statement), but according to the evidence Nos. 10 and No. 3, the plaintiff alleged that he was admitted to the above 30 million won (the KRW 1.5 million and the KRW 1.8 million after the receipt of the monthly payment) and the total amount of 20 million accounts, since the date on which the above money was remitted to the plaintiff and its amount claimed by the plaintiff, the above assertion is without merit.
Therefore, since claims on the notarial deed of this case remain 13.48 million won (=60 million won - 46.520,000 won), it shall be based on the notarial deed of this case.
