A defendant shall be punished by imprisonment for two years.

However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.

Punishment of the crime

On December 1, 2014, the Defendant: (a) 19 years of age, through the collective dialogue of the Handphone game called “Mapia 42”, had the victim C (n, 12 years of age); and (b) had the victim committed indecent act or sexual intercourse with the victim under 13 years of age with the knowledge that the victim was the sixth-year student at an elementary school in the course of dividing conversations via “Kakaok” on the following day.

On December 27, 2014, the Defendant committed an indecent act by compulsion by minors: (a) around 15:30 on December 27, 2014, the Defendant: (b) took the victim’s sexual intercourse in the “EM” located in Geumcheon-gu Seoul, Geumcheon-gu Seoul; (c) took the victim’s sexual intercourse with singing; (d) on the same day, at around 16:45, the Defendant committed an indecent act against the victim under the age of 13 by taking the victim’s sexual intercourse with his or her adjacent alley.
