1. Details of the disposition;

A. On January 4, 1996, the Plaintiff was discharged from military service on September 29, 1997, and was discharged from military service on the part of the main unit of the headquarters headquarters.

나. 원고는 2012. 8. 13. 다시 ‘추간판탈출증 L4-5, 복합부위통증증후군’에 대하여 국가유공자 등록신청을 하였는데, ‘추간판탈출증 L4-5’에 대하여는 재해부상군경요건에 해당하나 ‘복합부위통증증후군’에 대하여는 공상군경 및 재해부상군경 요건에 각 해당하지 않는다는 결정을 받았고, 그 이후 신체검사결과 상이등급 ‘6급 2항 6107호’로 판정되어 재해부상군경으로 등록되었다. 다. 원고는 2013. 7. 19. 다시 ‘추간판탈출증 L4-5’에 대하여 국가유공자 등록신청을 하였으나 2013. 10. 7. 공상군경요건에 해당하지 않는다는 결정을 받았고, 이에 대하여 행정소송을 제기하였으나 패소하였다(서울행정법원 2014구단12348호, 서울고등법원 2015누44082호). 라. 원고는 2016. 1. 20. 피고에게 ‘1997. 5.경 전투지휘 검열훈련 중 무거운 짐을 나르다가 오른쪽 발목을 삐끗하여 허리를 다친 이후부터 좌측 족지 2, 3, 4번에 관절염 증상을 보이면서 왼쪽 발목, 고관절 등으로 광범위하게 악화되어 결국 1997. 6.경 훈련준비 중 쓰러지게 되었는데, 당시 누구도 복합부위통증증후군(CRPS)에 대하여 진단해 주지 않아 지금까지 살아오다가 2015. 5. 18. 복합부위통증증후군(CRPS)에 대한 확진을 받게 되었다’고 주장하면서 "발과 발목의 복합부위통증증후군(1형)(이하, ‘이 사건 상이’라 한다)“을 신청 상이로 국가유공자 등록신청을 하였다.
