A. The plaintiff is C's spouse who completed the marriage report with C on May 13, 2003.

나. 피고는 2016. 9. 30. 자신이 근무하는 스포츠마사지�에 C이 손님으로 방문하여 C을 알게 되었고, C이 위 마사지�을 여러 차례 방문하면서 서로 가까워지게 되었다.

피고는 C에게 배우자가 있음을 알게 되었음에도 위 마사지�에서 C과 성관계를 가졌고, 이후 양산 소재 모텔, 피고의 주거지 등에서 C을 따로 만나 성관계를 갖는 등 C과 교제를 지속하였다.

다. 피고는 2017. 8.경 피고와 C 사이의 불륜관계를 알게 된 원고와 서로 다투게 되었고, 2017. 9. 30.에는 C의 아들이 위 마사지�으로 찾아와 불륜을 그만둘 것을 요구함에 따라 그 무렵 C과의 교제를 중단하였다. 라.

한편 피고는 2017. 8. 28. 원고가 운영하는 경주 소재 ‘D’ 홈페이지에 ‘여기 펜션 최악 중에 극악’, ‘제돈 내고 손님으로 가족들과 함께 즐거운 시간 될려고 갔는데 사모라는 여자분 정말 황당하기 짝이 없네요. 제가 사장님을 꼬셨답니다. 우리 펜션에 왜 왔냐고 따집니다’는 글을, 2017. 8. 29. 위 홈페이지에 ‘의부증 유치원 원장님’, ‘당신 남편 바람기나 제대로 잡으세요. 첨 보자마자 강간하려고 했던 사람이 남편입니다’는 글을 각 게시하였다

2. Whether liability for damages arises;

A. First, the part that the Defendant entered into a non-wheeled relationship with C is a health care unit, and the third party commits an unlawful act with one of the married couple, thereby infringing on or interfering with the marital nature and interfering with the maintenance of the marital life.
