Reasons
Punishment of the crime
The Defendant is an owner of a non-registered fishing vessel (a vessel of approximately 0.8 tons, four tons), and a captain.
1. No person who violates the law of fisheries shall capture, gather or cultivate marine animals and plants by any fishing method other than those under the Act of fisheries or the Management of Fishery Resources;

3. The owner of a fishing vessel violating the Fishing Vessels Act shall, when using the fishing vessel for sailing or fishing operations, undergo an inspection conducted by the Minister of Maritime Affairs and Fisheries with respect to the equipment of the fishing vessel.
Nevertheless, the defendant is identical with the above "2".
