A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

On March 18, 2008, the Defendant is a person who has violated Article 44(1) of the Road Traffic Act not less than twice, by issuing a summary order of KRW 700,000 for a crime of violating the Road Traffic Act at the Gwangju District Court on March 18, 200, and a fine of KRW 3,50,000 for a crime of violating the Road Traffic Act at the Gwangju District Court on July 2, 2010.

On May 8, 2018, under the influence of alcohol level of 0.196% among blood transfusion around 23:30, the Defendant driven a car using a 300-meter ctiballe vehicle from the Yangsan Park parking lot located in Gwangju Northern-dong, Gwangju Northern-gu, to the front road of the 1059, as it is located in the 1059 North-gu, Gwangju Northern-do.

The grounds for sentencing under Article 62-2(1) of the Criminal Act, Article 59 of the Act on the Protection, Observation, etc. of the said Act, and consideration of all the circumstances, including the criminal records of the Defendant, the alcohol concentration level in blood, driving distance, etc.
