The defendant's appeal is dismissed.

1. The summary of the grounds for appeal (the factual errors) did not err by assault the victim D, but the lower court erred by misapprehending the facts, thereby finding the Defendant guilty of the instant facts charged.

2. The testimony of the victim D at the original trial court is sufficiently trusted in light of the body of the victim and the consistency with the statements prepared by the police, and according to this, the facts charged of the crime of this case are fully found guilty.

Therefore, Defendant’s ground of appeal cannot be accepted.

3. In conclusion, the defendant's appeal is dismissed in accordance with Article 364 (4) of the Criminal Procedure Act on the ground that it is without merit. It is so decided as per Disposition.
