The prosecution of this case is dismissed.

1. On November 24, 2018, around 19:15, the Defendant assaulted the victim’s face face in his/her hands on four occasions on the ground that he/she was in a dispute with the victim D (the victim’s age 34).

2. Determination

(a) Applicable provisions of Acts: Article 260 (1) of the Criminal Act;

(b) Crimes of non-compliance with will: Article 260 (3) of the Criminal Act.

C. On December 5, 2018, after the institution of the instant indictment, a written agreement that the victim expressed his/her intention not to have the Defendant punished is prepared and submitted.

(d) Judgment dismissing public prosecution: Article 327 subparagraph 6 of the Criminal Procedure Act;
