피고인은 2015. 7. 29. 23:55경 원주시 문막읍 건등리에 있는 ‘대영닭갈비’라는 상호의 식당 앞 도로에서부터 같은 리에 있는 벧엘교회 앞 도로에 이르기까지 약 100m의 구간에서 혈중알콜농도 0.163%의 술에 취한 상태로 B 그랜저 승용차를 운전하였다.
